DIGITAL INFORMATION SHOULD ALWAYS be considered fragile. When you have potential evidence --Electronically Stored Information (ESI) or Data (ESD) -- on a computer or a digital storage medium, the sooner you get a Forensics Examiner involved, the better your chances of recovering that evidence. The longer you wait and the more that computer or device is left running, the more likely that the evidence may be destroyed!
INTERNAL INVESTIGATIONS should always be handled in a forensically sound manner. While the initial cause for the investigation may be a violation of corporate policy, that investigation may soon turn into a criminal or civil matter which may end up in court. Your case will always be handled by a Forensic Examiner who is certified in their area. WHAT WE HAVE FOUND in Corporate cases is that the IT Team generally starts handling internal cases. If you have even an inkling that this case will end up in court, you need to take your IT Staff off the case and turn it over to experienced professionals. IT Staff, as well meaning as they may be, have been responsible for evidence-contamination in numerous cases. This can hurt you and your case. The sooner an experienced Forensic Examiner is contacted, the better off you will be with your case. If the investigation is not handled in a forensically sound manner from the start, the court may consider the evidence to be contaminated, thereby causing it to be excluded from the case.
